For all purchases/orders made customers are entitled to a full refund (but not later than 7 working days after the day after you receive the goods) by sending a written notice of cancellation to us (or as otherwise provided by law). In such event the customer is liable to pay for the cost of returning the goods. The goods must be returned to Asiatique in the condition they were delivered in before a full refund is issued. We recommend our painted furniture is kept out of direct sunlight to avoid the paint colour fading and use of a damp cloth for cleaning. Because the furniture is painted, cracks and chips may appear in time but this is quite normal for wood furniture and should enhance the appearance.
We create an aged effect on some of our goods. Any stains, cracks and chipped paint is part of the desired effect and should not be considered a defect.
All warranties, conditions and other terms implied by statute or common law (save for the conditions implied by section 12 of the Sale of Goods Act 1979) are, to the fullest extent permitted by law, excluded from the contract.
Nothing in these conditions excludes or limits the liability of Asiatique : 1 for
death or personal injury caused by Asiatique negligence; or under section 2(3), Consumer Protection Act 1987; or for any matter which it would be illegal for Asiatique to exclude or attempt to exclude its liability; or for fraud or fraudulent misrepresentation.
Subject to the above Asiatique total liability in contract, tort (including negligence or breach of statutory duty), misrepresentation, restitution or otherwise, arising in connection with the performance or contemplated performance of the contract shall be limited to the contract price; and Asiatique shall not be liable to the customer for any pure economic loss, loss of profit, loss of business, depletion of goodwill or otherwise, in each case whether direct, indirect or consequential, or any claims for consequential compensation whatsoever (howsoever caused) which arise out of or in connection with the contract.
